1. Purpose

This Acceptable Use Policy ("AUP") defines the rules governing your use of the Eldem platform ("Service"). By using the Service, you agree to comply with this AUP in addition to the Terms of Service.

This AUP exists to protect users, third parties, and the integrity of the platform.

2. Permitted use

The Service is designed for legitimate business use by freelancers, agencies, consultants, and small businesses. Permitted activities include:

  • Creating, managing, and sending invoices and quotes to your own clients
  • Managing client relationships, projects, contracts, and proposals
  • Recording business expenses, income, and financial data for your own business
  • Communicating with your clients through Service-facilitated tools
  • Inviting team members to collaborate within your workspace
  • Accessing data you have entered via the API within published rate limits

3. Prohibited activities

3.1 Illegal activities

You must not use the Service to:

  • Violate any applicable local, national, or international law or regulation
  • Process, store, or transmit data in violation of data protection laws (GDPR, CCPA, Israeli Privacy Protection Law, or equivalents)
  • Facilitate money laundering, tax fraud, or financial crimes
  • Send fraudulent invoices or misrepresent financial transactions
  • Engage in any form of identity theft or impersonation

3.2 Harmful or abusive behaviour

You must not:

  • Harass, threaten, or abuse other users or third parties through the Service
  • Use the Service to distribute spam, unsolicited commercial messages, or phishing content
  • Send communications designed to deceive recipients into disclosing credentials or financial information
  • Create accounts using false identities or misrepresent your affiliation with any person or organisation

3.3 System integrity

You must not:

  • Attempt to gain unauthorised access to any account, system, or network associated with the Service
  • Conduct penetration testing, vulnerability scanning, or security research without our prior written consent
  • Circumvent, disable, or interfere with security features, access controls, or rate limits
  • Use automated scripts, bots, or scrapers to access the Service except via published API endpoints with proper authentication
  • Attempt to reverse-engineer, decompile, or derive source code from the Service
  • Upload or transmit viruses, malware, ransomware, or any code designed to harm or disrupt

3.4 Data and privacy

You must not:

  • Upload or process personal data of EU/EEA residents in a manner that violates GDPR
  • Store sensitive personal data (e.g. passwords, payment card numbers, health data) in free-text fields not designed for that purpose
  • Use Client Data entered by others without appropriate authorisation
  • Export or transfer data from the Service for use in competing services in a manner that violates our Terms

3.5 Resource abuse

You must not:

  • Deliberately overload, flood, or stress-test the Service infrastructure
  • Create an unreasonable number of accounts to circumvent plan limits
  • Use the Service to mine cryptocurrency or perform computationally intensive tasks unrelated to its intended purpose
  • Store data volumes that are grossly disproportionate to legitimate business use under your plan

3.6 Sanctions and export controls

You must not use the Service if you are:

  • Located in, or acting on behalf of entities in, a country subject to comprehensive sanctions by the US OFAC, EU, UK OFSI, or UN Security Council
  • Listed on any government sanctions list or designated as a restricted party

4. Client and third-party data

When you use the Service to manage data about your clients or third parties:

  • You are the data controller for that data; we are a data processor acting on your instructions
  • You are responsible for having a lawful basis to collect and process that data
  • You must comply with applicable privacy laws when collecting, storing, and using third-party data in the Service
  • You must not enter data about individuals without their knowledge where required by law

5. Intellectual property

You must not use the Service to:

  • Store, distribute, or transmit content that infringes any copyright, trademark, patent, trade secret, or other intellectual property right
  • Remove or alter copyright notices, watermarks, or proprietary markings

6. Reporting violations

If you become aware of a violation of this AUP or suspect the Service is being used for an unlawful purpose, report it to contact@eldem.io. We take all reports seriously and will investigate promptly.

7. Enforcement

We reserve the right, at our sole discretion, to:

  • Investigate suspected violations of this AUP
  • Suspend or terminate access for confirmed violations without prior notice where we determine there is an immediate risk
  • Report illegal activities to appropriate law enforcement or regulatory authorities
  • Cooperate with law enforcement investigations

For minor or unintentional violations, we will typically give notice and a reasonable opportunity to remedy the situation before taking action.

8. No limitation of our rights

This AUP supplements, and does not replace, our Terms of Service. All rights and remedies available under the Terms of Service remain available to us.

9. Changes to this policy

We may update this AUP from time to time. Material changes will be communicated by email at least 14 days before they take effect. Continued use of the Service after the effective date constitutes acceptance.
